1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you (whether an individual educator, institutional coordinator, or school administrator) and Toggle Technology (“we”, “us”, or “our”), concerning your access to and use of the Kwesh Studio platform located at https://kwesh.in.

By creating an account, accessing the studio, or purchasing paper unlock licenses, you expressly agree to be bound by all of these Terms and Conditions. If you do not agree, you are prohibited from using the Service.

2. Eligibility & Account Security

The Service is intended for professional educators, school teachers, academic coordinators, and educational institutions preparing Central Board of Secondary Education (CBSE) or allied curriculum assessments.

You are responsible for safeguarding your login credentials. You agree to notify us immediately of any unauthorized use of your account. Toggle Technology is not liable for any losses caused by unauthorized use of your credentials.

3. Proprietary Rights & Commercial License

Kwesh Studio is a commercial, proprietary SaaS application. All source code, user interface designs, dynamic physical A4 auto-pagination algorithms, CBSE question blueprints, schemas, and brand assets are the exclusive intellectual property of Toggle Technology.

Upon payment of applicable fees (per-paper unlock or institutional agreement), Toggle Technology grants you a non-exclusive, non-transferable, revocable license to generate, download, print, and distribute physical examination papers generated within the Service for examination administration within your academic institution.

4. Prohibited Activities

You agree not to:

• Systematically retrieve data, questions, or blueprints from the Service to create or compile a competing database or assessment engine;
• Circumvent, disable, or tamper with security-related features, authentication barriers, or digital diagnostic watermarks;
• Reverse engineer, decompile, or disassemble any part of the website or underlying API endpoints;
• Use automated scripts, bots, or crawlers to harvest content or automate transactions.

5. Pricing, Taxes & Billing (Razorpay)

All pricing is listed in Indian Rupees (INR). The standard fee to unlock and export a comprehensive unwatermarked examination paper is ₹199 (or as discounted by valid promotional coupons).

Applicable Goods and Services Tax (GST) is calculated and charged in compliance with Indian tax laws (CGST 9% + SGST 9% or IGST 18%). Upon transaction completion via Razorpay, an official GST tax invoice is automatically generated and permanently accessible in your studio invoices ledger.

6. Limitation of Liability

To the maximum extent permitted by applicable Indian law, in no event shall Toggle Technology, its directors, employees, or partners be liable to you for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and defined following the laws of India. Any legal action or proceeding arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
